Common use of Mitigation by Custodian Clause in Contracts

Mitigation by Custodian. Upon the occurrence of any event connected with the duties of the Custodian under this Contract which causes or may cause any loss, damage or expense to the Fund or any Portfolio, (i) the Custodian shall, and (ii) shall exercise reasonable efforts to cause any sub-custodian to, use reasonable efforts and take all reasonable steps under the circumstances to mitigate the effects of such event and to avoid continuing harm to the Fund and the Portfolios.
