Mitigation Requirements. 5 In accordance with the short-circuit analysis performed for the proposed Hassayampa 6 Interconnections, the following Mitigation facilities shall be installed: 7 H.1.1 Prior to the Generator Initial Synchronization Date, or as otherwise determined by the 8 E&O Committee, four (4) 230 kV breakers at the Westwing 230 kV Switchyard shall 9 be replaced.

The DB Contractor shall provide all necessary support to the District with respect to obtaining any such New Environmental Approval. If a New Environmental Approval becomes necessary for any reason other than those specified in Section 8.3.2, the DB Contractor shall be fully responsible for obtaining the New Environmental Approval and any other Environmental Approvals that may be necessary, and for all resulting requirements, as well as for any litigation arising in connection therewith. The District will reasonably assist the DB Contractor in obtaining any New Environmental Approvals. If the New Environmental Approval is associated with a VECP, or other DB Contractor- requested Change Order, the costs of obtaining and complying with the terms of the New Environmental Approval shall be considered in calculating the Contract Price adjustment under Section 15.2.4.
Mitigation Requirements. Design-Builder shall perform all environmental mitigation measures for the Project. The phrase “environmental mitigation measures" includes all requirements of the Environmental Approvals and similar Governmental Approvals, regardless of whether these requirements fall within a strict definition of the phrase. The Contract Price includes compensation for Design-Builder’s performance of all mitigation measures and for performance of all mitigation measures arising from New Environmental Approvals that Section 6.4.2 designates as Design-Builder’s responsibility, and the cost of all activities to be performed by Design-Builder as described in Section 10 of the Technical Provisions.
Mitigation Requirements. A. In order to mitigate air quality impacts on Fallow Lands, only the Best Management Practices ("BMPs") recommended by the US Department of Agriculture Natural Resources Conservation Service and listed below will be considered for payment reimbursement. The Dust Control BMP(s) must be selected and approved by IID prior to implementation or July 1, 2013, whichever is earlier. Payment will be based on the Dust Control BMP Reimbursement Schedule issued annually by the IID. 1) Plan ahead to start with plenty of vegetation residue, and maintain as much residue on fallowed fields as possible. Residue is more effective for wind erosion protection if left standing. 2) Avoid any tillage if possible. 3) Avoid any traffic on the field or tillage when fields are extremely dry to avoid pulverization. 4) If residues are not adequate, either small grain can be seeded about the first of the year to take advantage of winter rains or soil stabilization chemicals may be applied to fallowed lands. B. In addition to the above BMPs, in order to satisfy Imperial County dust control and mitigation requirements, Fallowing Party will comply with any lawful conditions required by the Imperial County Air Pollution Control District.

Mitigation Requirements. The provisions in this Section apply only to the extent TAMUS owns or controls any interest in the surface estate of the LEASED PREMISES. At least ten (10) days prior to COMPANY commencing the drilling of any well or ▇▇▇▇▇ upon the LEASED PREMISES or land pooled therewith, COMPANY must submit a Mitigation Plan to the System Real Estate Office for approval by TAMUS. (1) COMPANY must submit professional renderings and a visual mitigation plan for the proposed well site and production facility. All site and production equipment and facilities, including pumping units, storage tanks, buildings and structures, regardless of construction date, which are observable from any public roadway, private residence or place of business shall be well maintained and painted to the satisfaction of TAMUS. (2) To the maximum extent possible, oil and/or gas facilities shall be located away from prominent natural features such as distinctive rock and land forms, vegetative patterns, river crossings and other landmarks. (3) To the maximum extent possible, oil and/or gas facilities should be located to avoid crossing hills and ridges or silhouetting. (4) COMPANY shall use structures of minimal size to satisfy present and future functional requirements. (5) All lighting shall be directed away from residential areas or shielded from said areas to eliminate glare. (6) Construction of buildings or other enclosures may be required where facilities create noise and/or visual impacts incapable of sufficient mitigation because of proximity, density and/or intensity of adjacent land use. (7) Site border landscaping shall utilize shrubs and trees to the maximum extent possible, shaping cuts and fills to appear as natural forms, and incorporating natural screens into the overall final facility design to the maximum, reasonable extent possible, while maintaining the maximization of noise abatement as the priority. (b) ▇▇▇▇ and Fugitive Dust Mitigation. (1) COMPANY must submit an odor and fugitive dust mitigation plan for the proposed well site and production facility. Oil and/or gas facilities and equipment shall be operated in such a manner that odors and dust do not constitute a nuisance or hazard to public welfare and/or neighboring vegetation and livestock. Mitigation Requirements. Consultant will develop and summarize mitigation options and requirements identified for all impact categories as required based on the conclusions reached for each category. Product: Preliminary Draft Environmental Assessment, which will be submitted to FAA for review. Task 3.2 – Agency Coordination Objective: Obtain agency input on proposed improvements during the preparation of the resource impact analysis and distribute the Draft EA to agencies in order to allow for agency response to the project and the rulings made by the Draft EA. Approach: The Consultant will coordinate with the agencies listed below during the preparation of the resource impact analysis. The Consultant will provide the Proposed Action Summary along with a pre- addressed envelope and a response form. The response form will allow the agency to quickly and easily check boxes indicating a variety of responses from agreeing that the project has no adverse effect to requests for more information. The Consultant will place follow-up calls to the agencies to ensure that responses are returned in a timely manner. These agencies include: Task 3.3 - Prepare Draft EA Objective: Prepare a Draft EA, which will incorporate FAA comment on the already submitted Preliminary Draft EA (Task 3.1). The Draft EA will be prepared for public review. Approach: The Consultant and FAA will hold one meeting (phone call) to discuss FAA comments on the Preliminary Draft EA. The Draft EA will reflect FAA comments on the Preliminary Draft EA. Product: Draft Environmental Assessment, which will be available for public review. Task 3.4 - Public Review Draft EA Objective: Issue copies of Draft EA for public review. Approach: The Consultant will print up to 5 copies of the Draft EA for public review. The Consultant will prepare a notice that can be made available for print in the Federal Register and local newspapers of Product: A Draft EA for public review and distribution. Task 3.5 - Public Hearing Objective: A public hearing will be held to meet the requirements of the FAA and provide an opportunity for public input on the proposed improvements. Approach: A public hearing will be held to provide an opportunity for public comment on the Draft Environmental Assessment. The Consultant will provide a briefing to the public on the findings of the Draft EA and provide an opportunity for formal public testimony.
