Modifications in Using Agency Program. In the event that the estimates of the cost of the work exceed the project budget, the Using Agency and/or the Owner may at its discretion modify the Using Agency’s Program sufficiently to permit balancing the estimate with the available funds. The Program Manager agrees that modifications made for the purpose of balancing the estimate with the project budget shall not create a claim for additional work under this Program Manager contract.
