Common use of Modifications of Receivables or Contracts Clause in Contracts

Modifications of Receivables or Contracts. The Seller shall not extend, amend, forgive, discharge, compromise, waive, cancel or otherwise modify the terms of any Receivable or amend, modify or waive any term or condition of any Contract related thereto, except for Permitted Restructurings and such other modifications of past due Receivables as the Seller deems reasonably necessary to maximize the collection thereof to the extent expressly permitted by the Credit and Collection Policy.

The Seller shall not extend, amend, forgive, discharge, compromise, waive, cancel or otherwise modify the terms of any Transferred Receivable or amend, modify or waive any term or condition of any Contract related thereto; provided, except for Permitted Restructurings and such other modifications of past due Receivables as that the Seller deems reasonably necessary may authorize the Servicer to maximize the collection thereof to the extent take such actions as are expressly permitted by the terms of any Related Document or the Credit and Collection PolicyPolicies.
