Common use of Modified Consent Decree Requirements Clause in Contracts

Modified Consent Decree Requirements. All charter schools approved by the LAUSD Board of Education are bound by and must adhere to the terms, conditions and requirements of the Xxxxxx Xxxxx Modified Consent Decree (“MCD”) and other court orders imposed upon the District pertaining to special education. The MCD is a consent decree entered in a federal court class action lawsuit initially brought on behalf of students with disabilities in LAUSD. It is an agreement of the parties approved by the federal court and monitored by a court-appointed independent monitor. The MCD includes nineteen statistically measureable outcomes and facilities obligations that the District has to achieve to disengage from the MCD and federal court oversight. All charter schools are required to use the District’s Special Education Policies and Procedures Manual and Welligent, the District-wide web-based software system used for online Individualized Education Programs (“IEPs”) and tracking of related services provided to students during the course of their education. As part of fulfilling the District’s obligations under the MCD, student level data requests from District-operated and Charter-operated schools are made on a regular basis. The requested data must be submitted in the Office of the Independent Monitor’s (“OIM”) required format in accordance with the OIM’s required timelines and as follows: ● End of Year Suspension District ID, CSIS ID, last name, first name, date of birth, gender, grade, date of suspension, number of days suspended, and reason for suspension. ● Statewide Assessment Data (Including Charter Schools) The usual file including District ID. ● Norm day District ID, CSIS ID, last name, first name, date of birth, gender, grade, location code, school name and local district for all students enrolled on norm day. ● CBEDS (Including Charter Schools) ● All Students enrolled as of December 1 of each school year District ID, CSIS ID, last name, first name, date of birth, gender, grade, location code, school name and local district for all students enrolled on norm day. ● Dropout (Including Charter Schools) District ID, CSIS ID, last name, first name, middle name, date of birth, grade, last location, school name and local district ● Monthly SESAC and Suspension data (Including Charter Schools) ● Graduation roster from all LAUSD schools (Including Charter Schools) with 12th grade SWD The MCD requires charter schools to implement the District’s integrated student information system which is referred to as My Integrated Student Information System (MiSiS). MiSiS is a suite of applications which is designed to capture all District student data. All charter schools are required to utilize MiSiS in compliance with the requirements of the MCD and applicable timelines and upon the release of Milestone 8 which includes the final set of functionalities required to comply with the MCD. Upon charter school full utilization of MiSiS, the list of required data above will automatically be captured within MiSiS. Element 2 – Measurable Pupil Outcomes and – Method by which Pupil Progress Toward Outcomes will be Measured Element 3
