Common use of Monthly Servicer’s Certificate Clause in Contracts

Monthly Servicer’s Certificate. On or before the twenty-fifth calendar day of each month (or if such day is not a Servicer Business Day, on the immediately preceding Servicer Business Day), the Servicer shall prepare and deliver to the Issuer, the Indenture Trustee and the Rating Agencies a written report substantially in the form of Exhibit A hereto (a “Monthly Servicer’s Certificate”) setting forth certain information relating to Fixed Recovery Charge Payments received by the Servicer during the Collection Period immediately preceding such date; provided, however, that for any month in which the Servicer is required to deliver a Servicer’s Certificate pursuant to Section 4.01(c)(ii), the Servicer shall prepare and deliver the Monthly Servicer’s Certificate no later than the date of delivery of such Servicer’s Certificate.

On or before the twenty-fifth calendar day of each month (or if such day is not a Servicer Business Day, on the immediately preceding Servicer Business Day), the Servicer shall prepare and deliver to the Note Issuer, the Indenture Trustee and the Rating Agencies a written report substantially in the form of Exhibit A hereto (a “"Monthly Servicer’s 's Certificate”") setting forth certain information relating to Fixed Recovery Charge TC Payments received by the Servicer during the Collection Period immediately preceding such date; provided, however, that for any month in which the Servicer is required to deliver a Servicer’s 's Certificate pursuant to Section 4.01(c)(ii)) hereof, the Servicer shall prepare and deliver the Monthly Servicer’s 's Certificate no later than the date of delivery of such Servicer’s 's Certificate.

On or before the twenty-fifth (25th) calendar day of each month (or if such day is not a Servicer Business Day, on the immediately preceding Servicer Business Day), the Servicer shall prepare and deliver to the Issuer, the Indenture Trustee Trustee, and the Rating Agencies Agency a written report substantially in the form of Exhibit A hereto (a “"Monthly Servicer’s 's Certificate”") setting forth certain information relating to Fixed Recovery Uplift Charge Payments received by the Servicer during the Collection Period immediately preceding such date; provided, however, that for any month in which the Servicer is required to deliver a Servicer’s 's Payment Certificate pursuant to Section 4.01(c)(ii4.01(e)(ii), the Servicer shall prepare and deliver the Monthly Servicer’s 's Certificate no later than the date of delivery of such Servicer’s 's Payment Certificate.
