Common use of Motions Seeking Approval of the Settlement Clause in Contracts

Motions Seeking Approval of the Settlement. (1) As soon as practicable after the orders referred to in subsections 2.2(1) and 2.2(2) have been granted and the Notice of Certification and of Approval Hearings has been published, the Plaintiffs shall bring motions before the Courts for orders approving this Settlement Agreement. (2) The Ontario order approving this Settlement Agreement in the Ontario Electrolytic Action shall be proposed to the Ontario Court substantially in the form attached as Schedule “D”. The Ontario Plaintiff shall seek an order in the Ontario Film Action substantially in that same form, but with necessary modification for applicability to the Ontario Film Action. The orders approving this Settlement Agreement in the BC Electrolytic Action, the BC Film Action, and Québec Action shall be agreed upon by the Parties, shall mirror the substance and, where possible, the form of the Ontario order attached as Schedule “D”, as may be modified by the Ontario Court. (3) This Settlement Agreement shall only become final on the Effective Date.
