Nature of Business; Property; Indebtedness. The Borrower has not engaged in any business other than the operation of the Xxxxxxxxxx Mine as permitted hereunder. As of the Effective Date the operation of the Xxxxxxxxxx Mine is not being carried out or developed by any Subsidiaries of the Borrower. The Borrower (and each of its Subsidiaries (if applicable after the Effective Date)) has full ownership and legal and valid title to all its Property and such Property is not subject to any Liens other than Permitted Liens.
