Common use of NCAA and Other Governing Athletics Rules and University Rules Clause in Contracts

NCAA and Other Governing Athletics Rules and University Rules. (1) Assistant Coach agrees to know, recognize, and comply in all respects with NCAA and other Governing Athletics Rules and University Rules. In the performance of all his/her duties and obligations under this Agreement, Assistant Coach will abide by and comply with all Governing Athletics Rules and University Rules and all decisions issued by the University, as well as strive to comply with the spirit and intent of such rules. (2) If, at any time during the Term of this Agreement, Assistant Coach knows, or has reasonable cause to believe that he/she or any other person has violated, or allowed or caused to be violated, any Governing Athletics Rules or University Rules, or if Assistant Coach receives notice or information that the NCAA or the __________ Conference intends to investigate or to review any alleged violations of Governing Athletics Rules or University Rules, he/she must immediately report such information, knowledge, or belief to the Athletics Compliance staff. Such information, knowledge, or belief should also be immediately reported to the Head Coach and Athletics Director unless there are allegations that the Head Coach or Athletics Director were complicit in the alleged violation. (3) Pursuant to NCAA Bylaws 11.2.1 & 19.2.3, Assistant Coach has an affirmative obligation to cooperate fully in the NCAA infractions process, including the investigation and adjudication of a case. Specifically, full cooperation includes, but is not limited to: affirmatively reporting instances of noncompliance to the NCAA in a timely manner and assisting in developing full information to determine whether a possible violation has occurred and the details thereof; timely participation in interviews and providing complete and truthful responses; making a full and complete disclosure of relevant information, including timely production of materials or information requested, and in the format requested; disclosing and providing access to all electronic devices used in any way for business purposes; providing access to all social media, messaging and other applications that are or may be relevant to the investigation; and preserving the integrity of an investigation and abiding by all applicable confidentiality rules and instructions. (4) If Assistant Coach is found to be in violation of Governing Athletics Rules, whether while employed by the University or during prior employment at another NCAA member institution, Assistant Coach shall be subject to disciplinary or corrective action as set forth in this Agreement, as well as in the provisions of the NCAA enforcement procedures, including suspension without pay or termination of employment.

NCAA and Other Governing Athletics Rules and University Rules. He/She shall also educate and monitor any and all assistant coaches, graduate assistants, volunteer coaches, and other staff members under the supervision of Head Coach for compliance with NCAA and other Governing Athletics Rules and University Rules. In the performance of all his/her duties and obligations under this Agreement, Assistant Head Coach will abide by and comply with all Governing Athletics Rules and University Rules and all decisions issued by the University, as well as strive to comply with the spirit and intent of such rules. (2) It shall be the responsibility of Head Coach to promote an atmosphere of compliance within the Program and to monitor the activities regarding compliance of all assistant coaches and other administrators involved with the Program who report directly or indirectly to Head Coach. In this regard, Head Coach shall take special notice of NCAA Bylaw 11. 1.1.1, Head Coach Control (and any amendments made to that Bylaw during the Term of this Agreement). If, at any time during the Term of this Agreement, Assistant Head Coach knows, or has reasonable cause to believe that he/she or any other person has violated, or allowed or caused to be violated, any Governing Athletics Rules or University Rules, or if Assistant Head Coach receives notice or information that the NCAA or the __________ Conference intends to investigate or to review any alleged violations of Governing Athletics Rules or University Rules, he/she must immediately report such information, knowledge or belief to the Athletics Compliance staff and Athletics Director. If such information, knowledge, or belief includes allegations that the Athletics Director was complicit in the alleged violation, Head Coach must immediately report such information, knowledge, or belief to the Athletics Compliance staff. Such information, knowledge, or belief should also be immediately reported to President of the Head Coach and Athletics Director unless there are allegations that the Head Coach or Athletics Director were complicit in the alleged violationUniversity. (3) Pursuant to NCAA Bylaws 11.2.1 & 19.2.3, Assistant Head Coach has an affirmative obligation to cooperate fully in the NCAA infractions process, including the investigation and adjudication of a case. If, at any time during the Term of this Agreement, Assistant Coach knows, or has reasonable cause to believe that he/she he or any student-athlete or coach of any University Athletics program, any student, faculty member, other person employee, or agent of the University, or any outside individual has violated, or allowed or caused to be violated, any Governing Athletics Rules or University Rules, or if Assistant Coach receives notice or information that the NCAA or the __________ Conference Big 12 intends to investigate or to review any alleged violations of Governing Athletics Rules or University Rules, he/she or if Coach receives notice or information that any law is alleged to have been violated by any student-athlete, coach, or staff of any University Athletics program, including himself, he must immediately report such information, knowledge or belief to the Men’s Athletics Director, and to the Athletics compliance staff as appropriate. If such information, knowledge, or belief includes allegations that the Men’s Athletics Director was complicit in the alleged violation, Coach must immediately report such information, knowledge, or belief to the Athletics Compliance staff. Such information, knowledge, or belief should also be immediately reported to the Head Coach and Athletics Director unless there are allegations that the Head Coach or Athletics Director were complicit in the alleged violationUniversity President. If at any time during the Term of this Agreement, Assistant Agreement Associate Head Coach knows, knows or has reasonable cause to believe that he/she or any other person student-athlete, assistant coach, or staff member of any University Athletics Department program; any student, faculty member, or agent or employee of the University; or any outside individual has violated, or allowed or caused to be violated, any Governing Athletics Rules or University Rules, or if Assistant Associate Head Coach receives notice or information that the NCAA or the __________ Conference intends to investigate or to review any alleged violations of Governing Athletics Rules or University Rules, or if Associate Head Coach receives notice or information that any law is alleged to have been violated by any student-athlete, coach or staff member of any University Athletics Department program, including her/himself, he/she must immediately report such information, knowledge, knowledge or belief to the Athletics Compliance staff. Such information, knowledge, knowledge or belief should also be immediately reported to the Head Coach and Athletics Director or his/her designee(s) unless there are allegations that the Head Coach or Athletics Director or his/her designee(s) were complicit in the alleged violation. (3) Pursuant to NCAA Bylaws 11.2.1 & 19.2.3, Assistant Coach has an affirmative obligation to cooperate fully in the NCAA infractions process, including the investigation and adjudication of a case. If, at any time during the Term of this Agreement, Assistant Head Coach knows, or has reasonable cause to believe that he/she or any other person student-athlete, Head Coach, or staff member of any University Athletics Department program; any student, faculty member, or agent or employee of the University; or any outside individual has violated, or allowed or caused to be violated, any Governing Athletics Rules or University Rules, or if Assistant Head Coach receives notice or information that the NCAA or the __________ Conference intends to investigate or to review any alleged violations of Governing Athletics Rules or University Rules, or if Head Coach receives notice or information that any law is alleged to have been violated by any student-athlete or Head Coach of any University Athletics Department program, including him/herself, he/she must immediately report such information, knowledge, knowledge or belief to the Athletics Compliance staff. Such information, knowledge, knowledge or belief should also be immediately reported to the Head Coach and Athletics Director unless there are allegations that the Head Coach or Athletics Director were was complicit in the alleged violation. (3) Pursuant to NCAA Bylaws 11.2.1 & 19.2.3, Assistant Coach has an affirmative obligation to cooperate fully in the NCAA infractions process, including the investigation and adjudication of a case. Specifically, full cooperation includes, but is not limited to: affirmatively reporting instances of noncompliance to the NCAA in a timely manner and assisting in developing full information to determine whether a possible violation has occurred and the details thereof; timely participation in interviews and providing complete and truthful responses; making a full and complete disclosure of relevant information, including timely production of materials or information requested, and in the format requested; disclosing and providing access to all electronic devices used in any way for business purposes; providing access to all social media, messaging and other applications that are or may be relevant to the investigation; and preserving the integrity of an investigation and abiding by all applicable confidentiality rules and instructions. (4) If Assistant Head Coach is found to be in violation of Governing Athletics Rules, whether while employed by the University or during prior employment at another NCAA member institution, Assistant Head Coach shall be subject to disciplinary or corrective action as set forth in this Agreement, as well as in the provisions of the NCAA enforcement procedures, including suspension without pay pay, or termination the employment of employmentHead Coach may be terminated as provided in Section 7.A of this Agreement.
