Common use of Negotiation Between Senior Managers Clause in Contracts

Negotiation Between Senior Managers. (a) Within 10 days after delivery of the Response provided for in Section 13.02, the Senior Managers of both Members shall meet or communicate by telephone at a mutually acceptable time and place, and thereafter as often as they reasonably deem necessary, and shall negotiate in good faith to attempt to resolve the Dispute that is the subject of such Dispute Notice. If such Dispute has not been resolved within 45 days after delivery of the Dispute Notice, then the Members shall attempt to settle the Dispute pursuant to Section 13.04.

If such Dispute has not been resolved within 45 30 days after delivery of the Dispute Notice, then the Members parties shall attempt to settle the Dispute pursuant to Section 13.04clause (iii).
