Network Performance Commitment. Dallas Colo commits to a network performance level that results in a maximum average 4 milliseconds network route originating from the network interface between Dallas Colo and Customer’s hosted devices and traversing across the Dallas Colo Network, calculated over a 24-hour period. For purposes of this Agreement, any continuous and uninterrupted time interval during which Dallas Colo fails to achieve the aforesaid network performance level is referred to as a Network Performance Failure, and service credits for a given month shall be applicable according to the following guidelines: Network Performance Service Credit Less than 24 hours Commitment 24 to 36 hours 10% 36 to 48 hours 20% 48 to 60 hours 40% 60 to 72 hours 75% 72 to 96 hours 100%
