Nevada Provisions. Pursuant to Nevada Revised Statutes (“NRS”) 108.234, Landlord hereby informs Tenant that Tenant must comply with the requirements of NRS 108.2403 and NRS 108.2407. Tenant shall take all actions necessary under Nevada law to ensure that no liens encumbering Landlord’s interest in the Facilities arise as a result of Tenant’s construction of any Improvements or Alterations, which actions shall include, without limitation, the recording of a notice of posted security in the Official Records of ▇▇▇▇▇ County, Nevada, in accordance with NRS 108.2403, and either (i) establishing a construction disbursement account pursuant to NRS 108.2403(1)(b)(1), or (ii) furnishing and recording, in accordance with NRS 108.2403(1)(b)(2), a surety bond for the prime contract for the improvements or any alterations at the Facilities that meets the requirements of NRS 108.2415. Tenant may not begin any improvements or alterations in the Facilities until Tenant has delivered evidence satisfactory to Landlord that Tenant has complied with the terms of this Section. Failure by Tenant to comply with the terms of this Section shall permit Landlord to declare a Default hereunder. Notwithstanding the foregoing, Tenant’s ability to construct any improvement or any alteration is limited by the other provisions of the Lease. Further, Landlord shall have the right to post and maintain any notices of non-responsibility.
Nevada Provisions. Pursuant to Nevada Revised Statute 40.495, Purchaser hereby unconditionally and irrevocably waives the provisions of Nevada Revised Statute 40.430, and acknowledges that Lender may institute a separate action against Purchaser for the enforcement of Purchaser's obligations under this Agreement, irrespective of whether Lender has exercised any power of sale or other foreclosure remedies against the property subject to the Security Instrument.
Nevada Provisions. The following Nevada provisions do not limit the express choice of New York law as set forth in Section 10.3 of this Agreement and the other Loan Documents. (ii) To the maximum extent permitted by applicable law, Tenant hereby waives the provisions of NRS 118.175 through 118.205, inclusive, to the extent they are inconsistent with the other provisions of this Lease, including, but not limited to, the right to require Landlord to make reasonable efforts to rent the Site at a fair rental in the event Tenant abandons the Site, any statutory limitations on the damages which the Landlord is entitled to collect pursuant to this Lease in the event of an abandonment by Tenant and statutory provisions relating to the termination of this Lease by operation of law.
