New Beneficiaries. If prior to a Change in Control an individual is duly elected to the Board of Directors, Grantor agrees to notify the Trustee and the Beneficiaries’ Representative promptly of such election or appointment; provided, however, Grantor’s failure to so notify the Trustee and the Beneficiaries’ Representative shall not affect in any way an individual Director’s rights as a Beneficiary under this Trust. The Trustee and the Beneficiaries’ Representative shall have the right to rely on the accuracy and completeness of any statement provided to it by Grantor’s Secretary, Assistant Secretary or Chief Executive Officer as to the Beneficiary status of any individual.
New Beneficiaries. DVHA shall be responsible for educating individuals to help beneficiaries and potential beneficiaries of the Global Commitment to Health Medicaid Demonstration understand the requirements and benefits of the plan. Education activities may be conducted via mail, by telephone, and/or through face-to- face meetings. The Trustee shall have the right to rely on the accuracy and completeness of the most recent Exhibit A so provided.
New Beneficiaries. Each person to whom an interest in the Trust is properly transferred shall become a Beneficiary, and the transfer shall become effective, upon the execution by such transferee of this Agreement, acknowledged by the Trustee, and the issuance of a Certificate to him, her, or it. The Trustee must acknowledge any transfer made in conformity with this Agreement.
