Common use of New Goods Clause in Contracts

New Goods. If Customer is purchasing new Goods from WSECO, Customer acknowledges that (i) WSECO is not the manufacturer of the Goods; (ii) if the Goods include a manufacturer's warranty, WSECO will pass through to Customer the manufacturer's warranty to the extent permitted by the terms of such warranty; and

New Goods. If Customer is purchasing new Goods from WSECO, Customer acknowledges that (i) WSECO is not the manufacturer of the Goods; (ii) if the Goods include a manufacturer's warranty, WSECO will pass through to Customer the manufacturer's warranty to the extent permitted by the terms of such warranty; andand (iii) the manufacturer's warranty will be subject to all conditions and exclusions set forth therein. Upon request, WSECO shall provide Customer a copy of the applicable manufacturer’s warranty.
