If this Security Instrument shall be deemed to constitute a “mortgage investment” as defined by New York Real Property Law Section 125, then this Security Instrument shall and hereby does (i) confer upon the Agent the powers and (ii) impose upon the Agent the duties of trustees set forth in New York Real Property Law Section 126.
