Nothing contained in this Agreement is intended to subject to arbitration the prerogative of the Tribe or any of its instrumentalities or agencies to take any Governmental Action; provided however, that nothing herein shall impair Manager’s contractual remedies set out in this Section 18 of this Agreement with respect to any Governmental Action.
