No Assignment or Waiver. This Agreement shall not be considered as an attempted assignment of any policy of insurance or as a contract of insurance and shall not be construed to waive any right or remedy of any member of the Adaptec Group or the Roxio Group in respect of any Insurance Policy or any other contract or policy of insurance.
