Common use of No duty to enquire Clause in Contracts

No duty to enquire. No person dealing with the Chargee or any Receiver or any Delegate shall be concerned to enquire: (a) whether the power or rights conferred by or pursuant to this Deed are exercisable; (b) whether any consents, regulations, restrictions or directions relating to such rights have been obtained or complied with; (c) otherwise as to the propriety or regularity of acts purporting or intended to be in exercise of any such rights; or (d) as to the application of any money borrowed or raised.

No person dealing with the Chargee or Lender, any Receiver or any Delegate shall be concerned to enquire: (aA) whether the power or rights conferred by or pursuant to this Deed any Finance Document are exercisable; (bB) whether any consents, regulations, restrictions or directions relating to such rights have been obtained or complied with; (cC) otherwise as to the propriety or regularity of acts purporting or intended to be in exercise of any such rights; or (dD) as to the application of any money borrowed or raised.

No duty to enquire. No person dealing with the Chargee or Chargee, any Receiver or any Delegate shall be concerned to enquire: (a) whether any right which the power Chargee or rights conferred by any Receiver or pursuant Delegate is purporting to this Deed are exercise or any of its powers has arisen or become exercisable; (b) whether the Secured Liabilities have become payable or any consents, regulations, restrictions or directions relating to such rights have been obtained or complied withamount remains outstanding under the Loan Agreement; (c) otherwise as to the propriety or regularity of acts purporting or intended to be in exercise of any such rights; or (d) as to the application of any money borrowed or raisedraised or paid to the Chargee or any Receiver or Delegate; or (d) as to the propriety or regularity of such dealings.
