No Fiduciary Relationship or Interest in Funds. Notwithstanding any other provisions of this Agreement, under no circumstances shall this Agreement or the relationship between the Authority and the Mortgage Lender or the Mortgage Lender and the Servicer created thereby be construed as creating a fiduciary relationship between the Authority and the Mortgage Lender or the Mortgage Lender and the Servicer, or as granting to, or creating in, the Mortgage Lender any legal or equitable interest, right or title in or to any funds or accounts created under the Resolution.
