No Liability for Exercise of Powers. By way of supplement to the Trustee Xxx 0000, neither the Security Trustee, any Lender Party nor any Receiver shall be liable in respect of all or any part of the Charged Property or for any loss or damage which arises out of the exercise or the attempted or purported exercise of, or the failure to exercise any of, their respective powers, unless such loss or damage is caused by its or his gross negligence or wilful misconduct.
