Distributor may use its own Trademarks on Product Packaging, brochures and other promotional materials to identify itself as the distributor of the THIS EXHIBIT HAS BEEN REDACTED AND IS THE SUBJECT OF A CONFIDENTIAL TREATMENT REQUEST. REDACTED MATERIAL IS MARKED WITH [***] AND HAS BEEN FILED SEPARATELY WITH THE SECURITIES AND EXCHANGE COMMISSION. Product provided that Distributor has obtained the applicable Regulatory Approval. Notwithstanding any provision to the contrary, the Cipher trade name for which application has been made cannot be replaced without the prior written approval of Cipher.
