Early starts without overtime penalty, extra meal/crib breaks or meal money provided notified by end of work on previous day or shift, or where individual genuinely agrees to lesser notice. 2. Late starts on 2 hours notice without penalty for long distance or metro to country trips. 3. Ordinary hours of work may be worked on any combination of days in the week, including Saturday and Sunday, thus allowing for non-consecutive days off. 4. Early morning shift to apply as required, without majority employee vote. 5. Subject to compliance with Award regarding consecutive hours off duty, notification may be given by end of work on previous day or shift (or where individual genuinely agrees to lesser notice) of transfer between day work and shift work, or between shift rosters. 6. No RDO accruals for extended paid sick leave periods, ie for periods in excess of five calendar days. 13. Spare days or shifts (eg arising when others on sick leave) to be flexibly covered on an hour for hour TOIL (time off in lieu) basis where practicable. 14. Late start through fault of employee to attract ordinary time rates for balance of normal duration of ordinary time period, providing work is available or continues, ie no wages recovery through undue overtime earnings. 15. In accordance with subclause18(c) of this agreement and subject to there being no inconsistency with the other terms of this agreement, the following matters are agreed at a local level between the parties: 1. Starting times will be flexible to meet the needs of the operation. Management will ensure that the maximum possible notice is given of required start times. 2. Employees will undertake specified installation work and inspections/minor repairs of tanks/products as described in the Drivers Manual. (The operation of this sub-clause in terms of "minor repairs of tanks" will not in any substantive way vary the current work practice of employees). 3. Employees will effect wheel changes and minor repairs to vehicles within their competence/experience levels. 4. Employees will be paid an overnight allowance of $37.00 per night when unable to return to Orange because of driving commitments or working hours limits. 5. Employees will clean vehicle cabin interiors and wash vehicle exteriors. Tanks and other products will be washed with a hose before loading. 6. Employees will load vehicles using forklift trucks. 7. Employees will comply with Xxxxxx'x procedures for handling of cash and cheques. 8. Employees will comply with Xxxxxx'x customer service rules/standards as laid down in the Drivers Manual. 9. Employees will provide mobile phones and will be reimbursed for rental costs and company calls within ten days of Linfox receiving correctly completed expense claim forms. 10. Employees will not be entitled to Rostered Days off (RDOs). 11. Annual holidays will be taken in blocks of five days (minimum) unless otherwise agreed by management. 12. Employees will undertake alternative duties other than driving, in quiet periods and rehabilitation, provided the tasks are within the competency and experience level of the employee concerned. 13. Employees will be responsible for all tools and loose equipment on vehicles. 14. Linfox will consult with employees regarding hours worked, three months after the commencement of the contract. This consultation process will include discussions regarding the hours being worked by employees and rates of pay of employees. 15. Linfox will consult with employees regarding operation and rate of pay if during the life of this agreement, the fleet vehicle strategy requires implementation of vehicles such as B-Doubles. (It is agreed that if vehicles such as B-Doubles are introduced the CHR rate of pay for such classifications will be based on the appropriate Linfox Model Enterprise Agreement rate).

Any direction to start from such a location shall be reasonable, having due regard to the distance an employee is required to travel from their residence to commence work. Time spent at such location shall not constitute pick up and delivery duties and will comply not be counted as "loading / unloading" time for the purpose of payment in accordance with Xxxxxx'x customer service rules/standards as laid down the rates of pay in the Drivers ManualTransport Industry State Award (clauses 14.2 Kilometre Rate and 14.3 Payment for Loading and Unloading). 9. Employees will provide mobile phones and All drivers will be reimbursed required to undergo an annual medical examination. If drivers attend at a Linfox nominated practitioner, then costs will be borne by Linfox. Drivers attending their own practitioner will be responsible for rental their own costs and company calls within ten days shall need to produce written confirmation of fitness to Management (via a sealed envelope from the doctor) in response to all criteria identified by Management. In the event that the Linfox receiving correctly completed expense claim formsnominated practitioner in a particular situation is objectively unsuitable, nothing in this agreement shall prevent Linfox from reaching agreement with an employee as to an alternative practitioner. Where agreement is reached as to an alternative practitioner, costs will be borne by Linfox. The operational practicality of this sub clause will be reviewed by Linfox and the TWU if required by March 2005. 10. Employees Drivers will not be entitled to Rostered Days off (RDOs)responsible for complete pre trip vehicle check as per the Linfox Drivers Handbook. A driver that is in charge of a vehicle that runs out of fuel is prima facie negligent and the matter will be dealt with in accordance with the Counselling and Discipline procedure contained in clause 15 of this agreement. 11. Employees Two way communication between vehicle operators and management is seen as fundamental to the success of this Enterprise Agreement. In this regard a site Consultative Committee is seen as an integral and important part of the organisation of work at the Enterprise Agreement. For this reason, it is imperative that members of the Committee are available with due notice to resolve matters of mutual interests, and that they carry out their duties in a responsible and timely manner. Both parties accept that certain information could be considered as commercially sensitive or subject to security restrictions. Every effort will be responsible for all tools and loose equipment on vehiclesmade by both parties to respect such considerations of confidentiality while making available as much information as possible. 14. Linfox A roster of annual and long service leave will consult with be drawn up. At all times, flexibility must be maintained to accommodate marked fluctuations, customer requirements and personal needs. Employees will co-operate to there fullest in embracing all aspects of future technology. In return, its introduction shall not be undertaken until the company has adequately trained employees in its effective use. 17. Vehicle operators agree to exercise prudent care in the safe custody and transfer/use of equipment and product entrusted to them. Employees acknowledge that Linfox is contractually bound to meet the cost of damaged stock for which it is deemed responsible. 18. Vehicle Operators agree to properly administer, complete and be responsible for the accuracy of details entered onto any/all forms issued by Linfox that are necessary for Linfox to fulfill its contractual or service requirements specified by Coca-Cola, and to monitor and record details relevant to the operation of its business. This includes but not restricted to the following: Clock on and off daily Time sheets (signed daily) Vehicle condition reports Accident reporting Odometer readings daily 19. Where required, employees will perform extraneous duties within their competence, including assisting warehouse personnel unloading of vehicles in our regional locations. In accordance with arrangements between Linfox and the customer, there will be no restrictive work practices inconsistent with award provisions. 20. Employees may only smoke in designated areas. 21. Company policy relating to accident damage, three (3) strike policy will be applied as per staff handbook and qualification record as covered in the induction process. 22. It is recognised that the taking of R.D.O.'s on a flexible basis is of benefit to Linfox, its vehicle operators and the customer. By mutual agreement, a vehicle operator may wish to sell a portion of his RDO hours back to the fleet vehicle strategy requires implementation company at their current value. Each employee who uses this option must maintain a minimum of vehicles such as B-Doublesone (1) weeks RDO in his/hers RDO bank. 23. (Normal starting times for employees on day shift will be 6:00am. Employees may be required to alter start times if required to meet customer allocation slots. 24. Normal starting hours for employees on afternoon shift will be 10:00pm. The parties to this Enterprise Agreement agree that in the event that the client can not use the services of Linfox relating to industrial disputes, breakdowns, etc, caused by them, that employees of Linfox agree to offset rostered days off and/or accrued leave entitlements and/or credit against future days off to cover the period. Prior to the above Linfox Management agree to investigate all possibilities of re- deploying employees on a temporary basis throughout other Linfox contracts on a voluntary basis, however if volunteers are not forthcoming work will be allocated using the last on first off rule. 26. It is agreed that if vehicles such as B-Doubles are introduced the CHR rate of pay for such classifications where necessary to meet peak and/or short term customer service demands Linfox will be based entitled to temporarily transfer vehicle operators employed in other contracts into the Coca-Cola contract and/or move Coca-Cola vehicle operators onto other contracts without financial loss. These transfer conditions shall include the reallocation of Linfox owned equipment, most importantly vehicles. Allocation of work outside of the Coca-Cola contract will be on a voluntary basis, however if volunteers are not forthcoming work will be allocated using the appropriate Linfox Model Enterprise Agreement rate)last on first off rule. 27. Redundancy and retrenchment is an absolute last resort where an employee cannot be reasonably allocated work at another site. 28. Management and employees recognise the importance to maintain a harmonious workplace. (The operation of this sub-clause in terms of "minor repairs of tanks" will not in any substantive way vary the current work practice of employees)at another contract or site. 3. Employees will effect wheel changes and minor repairs Where there is a temporary shortage of work, employees may be temporarily redeployed to vehicles within their competence/experience levelsother contracts or sites without loss of ordinary time pay, or may be permitted to take accrued RDO's or annual leave. 4. Employees Linfox will be paid an overnight allowance under no restrictions regarding the introduction, deployment and utilisation of $37.00 per night when unable to return to Orange because of driving commitments or working hours limitsnew technology (including hand-held terminals, truck monitoring devices and electronic seals) with employees fully co-operating in its use following appropriate training. 5. Employees will clean vehicle cabin interiors RDO's may be either taken as scheduled or worked. If worked at no penalty to Linfox, then by agreement with the employee concerned the RDO may be deferred (ie a day in lieu granted), banked and wash vehicle exteriors. Tanks and other products will be washed later taken with a hose before loadingleave, or brought back to ordinary rates. 6. Employees Meal and crib breaks will load vehicles using forklift trucksbe taken by individual employees on a staggered basis as work permits. 7. Employees Where required, employees will comply with Xxxxxx'x procedures for handling perform extraneous duties within their competence, including assisting stores and warehouse personnel in the loading and unloading of cash and chequesvehicles. 8. Employees There will comply be no restrictive work practices inconsistent with Xxxxxx'x customer service rules/standards as laid down in the Drivers Manualaward provisions. 9. Employees will provide mobile phones and will be reimbursed Late start through fault of employee to attract ordinary time rates for rental costs and company calls within ten days balance of Linfox receiving correctly completed expense claim formsnormal duration of ordinary time period, providing work is available or continues, ie no wages recovery through undue overtime earnings. 10. Employees will Trained vehicle operators may, by agreement, be required to operate forklift equipment in exceptional circumstances ie whereby no permanent Linfox forklift driver is available to assist in the ongoing vehicle utilisation. The intention is not be entitled to Rostered Days off (RDOs)cause conflict with permanent Linfox or customer forklift operators. 11. Annual holidays will be taken in blocks of five days (minimum) unless otherwise agreed by management. 12. Employees will undertake alternative duties other than drivingLinfox may, in quiet periods and rehabilitation, provided the tasks are within the competency and experience level of the employee concerned. 13. Employees will be responsible for all tools and loose equipment on vehicles. 14. Linfox will consult with employees regarding hours worked, three months after the commencement of the contract. This consultation process will include discussions regarding the hours being worked by employees and rates of pay of employees. 15. Linfox will consult with employees regarding operation and rate of pay if during the life of this agreement, implement an incentive payment arrangement for employees. If such an arrangement is to be implemented Linfox will consult with employees prior to the fleet commencement of any new payment arrangement. 12. Two way communication between vehicle strategy requires implementation operators and management is seen as fundamental to the success of this Enterprise Agreement. In this regard a site Consultative Committee is seen as an integral and important part of the organisation of work at the Enterprise Agreement. For this reason, it is imperative that members of the Consultative Committee are available at all times to resolve matters of mutual interest and that they carry out their duties in a responsible and timely manner. Both parties accept that certain information could be considered as commercially sensitive or subject to security restrictions. Every effort will be made by both parties to respect such considerations of confidentiality while making available as much information as possible. 13. It is recognised by all parties that customer service is the core value of or business and this must never be intentionally compromised. 14. This value will be the motivating factor prevailing in all decisions throughout the Enterprise Agreement and every effort to improve service levels to our clients and in turn out client's customer will be the goal of all employees and staff. In particular the parties to this enterprise agree: (a) Linfox will undertake to have its client, Coca-Cola specifies and agrees what their standard delivery requirements are so that these can be communicated to and understood by all. (b) The parties agree that the standard requirement for delivery may change from time to time at the request of the client, Coca-Cola. In this case changes will be notified to the Consultive Committee and that the Committee will investigate any concerns in relation to the requirements. It must be recognised that service levels provided by the parties to this Enterprise Agreement will be in accordance with the wishes of the client. (c) Under no circumstance will parties to this Enterprise Agreement engage in an confrontation, heated exchange or argument with any employee of our client, any one our client's customers, members of the general public or fellow employee. All incidents of such nature are to be reported to Linfox Management. (d) Current levels of services offered by routine drivers will be maintained. The following guidelines will apply: (i) Drinks will not be stacked away in cold rooms by route drivers except at the driver's discretion. (ii) Deliveries will be made in accordance with the guidelines and regulations issued by Workplace Health and Safety. (e) If any driver has a problem with the level of service requested, he will complete the delivery as required on that occasion and report the problem to his site manager upon his return. In return, management will commit to resolving the problem before the next delivery is due. (f) Linfox Coca-Cola Drivers will ensure that their personal appearance and vehicle presentation shall reflect a very high standard at all times throughout the market place. A well presented employee and company vehicle rates second to none in the priority list. Linfox agrees to undertake all necessary action to satisfy its employees and itself that all loads are safe. Linfox will use its best endeavours to obtain from Coca-Coal reasonable notice as to any changes to product. 15. Work allocation is to be carried out by an appointed staff member bearing in mind the customer's requirements relating to the service levels at all times. The allocation and subsequent performance of work will be monitored and regularly reviewed by the Consultative Committee to ensure that all employees are being treated equally where possible. 16. Linfox personnel will carry out this function, where appropriate, with the Coca-Cola Distribution Team maintaining a function as overseer of service and efficiency levels. Work will be allocated on the basis of a full day's work within the driver's area. It is accepted that there will be flexibility in boundaries where it is logical for better load co-ordination. It is further accepted that if there is not a full days work within a driver's normal area then he will accept work from another area its available. 17. Employees will undertake training to enable them to participate in the scheduling and allocation of work. Where the employee is suitably qualified to undertake the task he may be required to undertake this task when required. 18. Vehicle operators agree to exercise prudent care while handling cash and cheques. An allowance of money handling is paid weekly to each driver and safes are fitted in all vehicles such and must be used. 19. Repetitive occurrences of cash and stock shortages will be treated as B-Doublesdriver negligence and failure to comply with company settlement policy will result in immediate dismissal. 20. Company policy relating to accident damage, three (3) strike policies will be applied as per staff handbook and qualifications record ad covered in the induction process. 21. The parties of this Enterprise Agreement agree that in the event that the client can not use the services of Linfox for a period in excess of 24 hours relating to industrial disputes, breakdowns etc, caused by them, that employees of Linfox agree to offset accrued leave entitlement and/or credit against future days off to cover the period. Prior to be above Linfox Management agrees to investigate all possibilities of re- deploying employees on a temporary basis through other Linfox contracts. 22. It is agreed that if vehicles such as B-Doubles are introduced the CHR rate of pay for such classifications where necessary to meet peak and/or short term customer service demands Linfox will be based entitled to transfer vehicles operators employed in other contracts into the Coca-Cola contract and/or move Coca-Cola vehicle operators into other contracts without financial loss. These transfer's conditions shall include the re-allocation of Linfox owned equipment, most importantly vehicles. Allocation of work outside the Coca-Cola contract will be on a voluntary basis, however if volunteers are not forthcoming work will be allocated by the appropriate Linfox Model Enterprise Agreement rate)Company.
