Common use of No Suits Clause in Contracts

No Suits. There are no suits, arbitrations or other proceedings pending or threatened against Buyer, any Buyer’s Nominee or any New Lessor before any court or administrative agency against or affecting Buyer which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Buyer or its ability to perform under the Sale Documents to which it is a party.

No Suits. There are no suits, arbitrations or other proceedings pending or threatened against Buyer, any Buyer’s Nominee or any New Each Seller and Existing Lessor before any court or administrative agency against or affecting Buyer Seller which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Buyer Seller or its ability to perform under the Sale Documents to which it is a party.

No Suits. There are no suits, arbitrations suits or other proceedings pending or threatened against Buyer, any Buyer’s Nominee or any New Lessor SELLER before any court or administrative agency against or affecting Buyer SELLER which, if adversely determined, would have a material adverse effect on the business, assets or condition (financial or otherwise) of Buyer or its SELLER's ability to perform its obligations under the Sale Documents to which it is a partythis Purchase Agreement.
