The Common Stock of the Company (i) shall be listed on the Nasdaq Capital Market and (ii) shall not have been suspended from trading on the Nasdaq Capital Market. The Company shall have filed a Listing of Additional Shares application to cause the Shares and the shares of Common Stock issuable upon exercise of the Warrants to be listed on the Nasdaq Capital Market.
