Common use of No Unauthorized Devices or Tampering Clause in Contracts

No Unauthorized Devices or Tampering. You agree not to attach any unauthorized device to Polar Equipment or the Services. If you make any unauthorized connection or modification to Polar Equipment or the Services or any other part of our network, we may terminate your Service and recover such damages as may result from your actions. Unless expressly authorized by us, you agree not to install anything to intercept or receive any of the Services offered over our network or to assist any person in intercepting or receiving any of the Services offered over our network. You also agree that you will not attach anything to the Inside Wiring, Polar Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, or unreturned Polar Equipment or other equipment owned by Polar, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

You also agree that you will not attach anything to the Inside Wiring, Polar Mountain Telephone Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar Mountain Telephone Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar Mountain Telephone Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, damaged or unreturned Polar Mountain Telephone Equipment or other equipment owned by PolarMountain Telephone, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar Mountain Telephone have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

You also agree that you will not attach anything to the Inside Wiring, Polar JTL Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our cable network or degrades our cable network’s 's signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar JTL Equipment or any other part of our cable network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar JTL Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, damaged or unreturned Polar JTL Equipment or other equipment owned by PolarJTL, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring• For PHONE Customers. You may install Inside Wiring, such as additional cable wiring will be liable for all authorized and outlets, provided it does not interfere with unauthorized PHONE use at the Premises. You agree to notify us immediately in writing or by calling our customer service line during normal operations business hours if you become aware at any time of our networkunauthorized use of your PHONE Services. If you have fail to notify us install Inside Wiringin a timely manner, we will charge you for that service. Regardless of who installed ityour Services may be terminated without notice, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiringwith additional charges to you.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

You also agree that you will not attach anything to the Inside Wiring, Polar Foothills Communications Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar Foothills Communications Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar Foothills Communications Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, damaged or unreturned Polar Foothills Communications Equipment or other equipment owned by PolarFoothills Communications, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar Foothills Communications have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service. Use of Services You will not use the Foothills Communications Equipment at any time at an address other than your premises without our prior written authorization. You will not use or permit another to use the Foothills Communications Equipment or the Service(s), directly or indirectly, for any unlawful purpose, including, but not limited to, in violation of any posted Foothills Communications policy applicable to the Services. Use of the Foothills Communications Equipment or Services for transmission, communications or storage of any information, data or material in violation of any U.S. federal, state or local regulation or law is prohibited. The Service is a consumer grade service and is not designed for or intended to be used for any commercial purpose. You may not resell the Service, use it for high volume purposes, or engage in similar activities that constitute such use (commercial or non- commercial). We reserve the right to suspend or terminate your Service if your use exceeds normal volumes. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Foothills Communications Equipment and/or Services and that you shall have sole responsibility for ensuring that all other users understand and comply with the terms and conditions of this Agreement and any applicable Foothills Communications policies including, but not limited to, acceptable use and privacy policies. You further acknowledge and agree that you shall be solely responsible for any transactions, including, without limitation, purchases made through or in connection with the Services. You agree to indemnify, defend and hold harmless Foothills Communications and its affiliates, suppliers, and agents against all claims and expenses (including reasonable attorney fees) arising out of the use of the Services, the Foothills Communications Equipment and/or the Customer Equipment or the breach of this Agreement or any of the applicable Foothills Communications policies by you or any other user.

You also agree that you will not attach anything to the Inside Wiring, Polar WCVT Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar WCVT Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar WCVT Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, or unreturned Polar WCVT Equipment or other equipment owned by PolarWCVT, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar WCVT have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service. Use of Services‌ You will not use the WCVT Equipment at any time at an address other than the Premises without our prior written authorization. You will not use or permit another to use the WCVT Equipment or the Service(s), directly or indirectly, for any unlawful purpose, including, but not limited to, in violation of any posted WCVT policy applicable to the Services. Use of the WCVT Equipment or Services for transmission, communications or storage of any information, data, or material in violation of any U.S. federal, state or local regulation or law is prohibited. You acknowledge that you are accepting this Agreement on behalf of all persons who use the WCVT Equipment and/or Services and that you shall have sole responsibility for ensuring that all other users understand and comply with the terms and conditions of this Agreement and any applicable WCVT policies including, but not limited to, acceptable use and privacy policies. You further acknowledge and agree that you shall be solely responsible for any transactions, including, without limitation, purchases made through or in connection with the Services. You agree to indemnify, defend, and hold harmless WCVT and its affiliates, suppliers, and agents against all claims and expenses (including reasonable attorney fees) arising out of the use of the Services, the WCVT Equipment and/or the Customer Equipment or the breach of this Agreement or any of the applicable WCVT policies by you or any other user.

You also agree that you will not attach anything to the Inside Wiring, Polar Peoples Equipment or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakage. You hereby agree that we may recover damages from you for tampering with any Polar Peoples Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult if not impossible to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration or improper use of Polar Peoples Equipment. You therefore agree to pay us as liquidated damages, the sum of $500.00 per device used to receive the unauthorized Services in addition to our cost to replace any altered, damaged, damaged or unreturned Polar Peoples Equipment or other equipment owned by PolarPeoples, including any incidental costs. The unauthorized reception of the Services may also result in criminal fines and/or imprisonment. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar Peoples have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

If you make or assist any person to make any unauthorized connection or modification to Polar Equipment or the Services Service(s) or any other part of our network, we may terminate your Service Service(s) and recover such damages as may result from your actions. Unless expressly authorized by us, you agree not to install anything to intercept or receive any of the Services offered over our network or to assist any person in intercepting or receiving any of the Services offered over our network. You also agree that you will not attach anything to the Inside Wiring, Polar Equipment Equipment, or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakagedisruption, we may terminate your Service(s) and recover such damages as may result from your actions. You hereby also agree that we may recover damages from you for tampering with any Polar Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult difficult, if not impossible impossible, to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration tampering with Equipment or improper use of Polar Equipmentour network. You therefore agree to pay us as liquidated damages, and not as a penalty, the sum of $500.00 per device used to receive the unauthorized Services Service(s) in addition to our cost to replace any altered, damaged, or unreturned Polar Equipment or other equipment owned by PolarSurf Broadband Solutions, including any incidental costs. The unauthorized reception of the Services Service(s) may also result in criminal fines and/or imprisonment. c. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar Surf Broadband Solutions have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

If you make or assist any person to make any unauthorized connection or modification to Polar Equipment or the Services Service(s) or any other part of our network, we may terminate your Service Service(s) and recover such damages as may result from your actions. Unless expressly authorized by us, you agree not to install anything to intercept or receive any of the Services offered over our network or to assist any person in intercepting or receiving any of the Services offered over our network. You also agree that you will not attach anything to the Inside Wiring, Polar Equipment Equipment, or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakagedisruption, we may terminate your Service(s) and recover such damages as may result from your actions. You hereby also agree that we may recover damages from you for tampering with any Polar Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult difficult, if not impossible impossible, to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration tampering with Equipment or improper use of Polar Equipmentour network. You therefore agree to pay us as liquidated damages, and not as a penalty, the sum of $500.00 per device used to receive the unauthorized Services Service(s) in addition to our cost to replace any altered, damaged, or unreturned Polar Equipment or other equipment owned by PolarSurf Internet, including any incidental costs. The unauthorized reception of the Services Service(s) may also result in criminal fines and/or imprisonment. c. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. If you have us install Inside Wiring, we will charge you for that service. Regardless of who installed it, we consider the Inside Wiring your property or the property of whomever owns the Premises. Accordingly, you are responsible for the repair and maintenance of the Inside Wiring, unless you and Polar Surf Internet have agreed otherwise in writing. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.

Unless expressly authorized by us, you agree not to install anything to intercept or receive any of the Services offered over our network or to assist any person in intercepting or receiving any of the Services offered over our network. You also agree that you will not attach anything to the Inside Wiring, Polar Equipment Equipment, or Customer Equipment, whether installed by you or us, which singly or together impairs the integrity of our network or degrades our network’s signal quality or strength or creates signal leakagedisruption, we may terminate your Service(s) and recover such damages as may result from your actions. You hereby also agree that we may recover damages from you for tampering with any Polar Equipment or any other part of our network or for receiving unauthorized Service(s). You agree that it would be difficult difficult, if not impossible impossible, to calculate precisely the lost revenue resulting from your receipt of unauthorized Service(s) or the alteration tampering with Equipment or improper use of Polar Equipmentour network. You therefore agree to pay us as liquidated damages, and not as a penalty, the sum of $500.00 per device used to receive the unauthorized Services Service(s) in addition to our cost to replace any altered, damaged, or unreturned Polar Equipment or other equipment owned by PolarROCKET CONNECT, including any incidental costs. The unauthorized reception of the Services Service(s) may also result in criminal fines and/or imprisonment. c. Inside Wiring. You may install Inside Wiring, such as additional cable wiring and outlets, provided it does not interfere with the normal operations of our network. (If you do not own the Premises, contact your landlord or building manager about the repair or maintenance of Inside Wiring.) If you have us repair or maintain the Inside Wiring, we will charge you for that service.service 7. USE OF SERVICES You agree that the Service(s) and the Equipment will be used only for personal, residential, noncommercial purposes, unless otherwise specifically authorized by us in writing. You will not use the Equipment at any time at an address other than the Premises without our prior written authorization. You agree and represent that you will not resell or permit another to resell the Service(s) in whole or in part. You will not use or permit another to use the Equipment or the Service(s), directly or indirectly, for any unlawful purpose, including, but not limited to, in violation of any posted ROCKET CONNECT policy applicable to the Service(s) including, but not limited to, the AUP (as defined below) and privacy policies. Use of the Equipment or Service(s) for transmission, communication or storage of any information, data or material in violation of any U.S. federal, state or local regulation or law is prohibited. You acknowledge that you are accepting this Agreement on behalf of all persons who use the Equipment and/or Service(s) at the Premises and that you shall have sole responsibility for ensuring that all other users understand and comply with the terms and conditions of this Agreement and any applicable ROCKET CONNECT policies including, but not limited to, acceptable use and privacy policies. You further acknowledge and agree that you shall be solely responsible for any transactions, including, without limitation, purchases made through or in connection with the Service(s). You agree to indemnify, defend and hold harmless ROCKET CONNECT and its affiliates, suppliers, contractors, distributors, licensors, business partners and agents and their respective officers, directors, members, employees, shareholders, successors, representatives, and assigns (collectively, the "ROCKET CONNECT Parties") against all claims and expenses (including reasonable attorneys’ fees) arising , directly or indirectly, out of the use of the Service(s) (including, but not limited to, vehicular damage and personal injury), the Equipment and/or the Customer Equipment or the breach of this Agreement or any of the applicable ROCKET CONNECT Policies by you or any other user of the Service(s) at the Premises. The ROCKET CONNECT Acceptable Use Policy (“AUP”) and other policies concerning HSI are posted at xxx.xxxxxxxxxxxxx.xxx (or an alternative website if we so notify you) (collectively, the "ROCKET CONNECT Policies"). You further agree that ROCKET CONNECT may modify the ROCKET CONNECT Policies from time to time. Notwithstanding anything to the contrary in this Agreement, YOU ACKNOWLEDGE AND AGREE THAT THE TERMS OF THE ROCKET CONNECT POLICIES MAY BE PUT INTO EFFECT OR REVISED FROM TIME TO TIME WITH OR WITHOUT NOTICE BY POSTING A NEW VERSION OF THE AUP OR POLICY AS SET FORTH ABOVE. YOU AND OTHER USERS OF THE SERVICE(S) SHOULD CONSULT THE AUP AND ALL POSTED POLICIES REGULARLY TO CONFORM TO THE MOST RECENT VERSION. IF YOU CONTINUE TO USE OR RECEIVE SERVICE(S) AFTER THE CHANGE, THIS WILL CONSTITUTE YOUR ACCEPTANCE OF ANY SUCH REVISIONS. 2767236v4/27823-0001
