No Waiver of Rights by the Banks. No failure on the part of the Administrative Agent or of any Bank to exercise, and no delay in exercising, any right or remedy hereunder or under the Credit Documents shall operate as a waiver thereof, except as provided in Section 17, nor shall any single or partial exercise by the Administrative Agent or any Bank of any right, remedy or power hereunder or thereunder preclude any other or future exercise thereof, or the exercise of any other right, remedy or power. The rights, remedies and powers provided herein and in the Credit Documents are cumulative and not exclusive of any other rights, remedies or powers which the Administrative Agent or the Banks or any holder of a Credit Document would otherwise have. Notice to or demand on the Company in any circumstance in which the terms of this Agreement or the Credit Documents do not require notice or demand to be given shall not entitle the Company to any other or further notice or demand in similar or other circumstances or constitute a waiver of the rights of the Administrative Agent or any Bank or the holder of any Credit Document to take any other or further action in any circumstances without notice or demand.
