Nomination by Buyer with Consent. The Buyer admits and accepts that before the execution and registration of conveyance deed of the Said Flat And Appurtenances, the Buyer will be entitled to nominate, assign and/or transfer the Buyer’s right, title, interest and obligations under this Agreement subject to the covenant by the nominee that the nominee will strictly adhere to the terms of this Agreement and subject also to the following conditions: (a) The Buyer shall make payment of all dues of the Seller in terms of this Agreement up to the time of nomination. (b) The Buyer shall obtain prior permission of the Seller and the Buyer and the nominee shall be bound to enter into a tripartite agreement with the Seller. (c) The Buyer shall pay a sum calculated @ Rs.25/- (Rupees twenty five) per square feet as and by way of nomination fees to the Seller.
