Common use of Non-Appropriation; Adequate Funding Clause in Contracts

Non-Appropriation; Adequate Funding. District is prohibited from contracting for services for which it has not received appropriated funds. If payment for work under this Contract extends into District’s next fiscal year, District’s obligation to pay for such work shall be subject to approval of future Board of Education (“Board”) appropriations to fund this Contract. Moreover, continuation of this Contract at specified levels is specifically conditioned on adequate funding under the District’s budget adopted in June of each year. District reserves the right to adjust the level of services provided for in this Contract in accordance with funding levels adopted by the Board.
