Common use of Non-Assertion Clause in Contracts

Non-Assertion. During the term of the Agreement, You will not assert, nor will You authorize or assist any third party to assert, against NI, its affiliates or any of their respective customers, vendors, business partners, or licensors, any patent infringement claim with respect to any Services that You elect to use.

Non-Assertion. During and after the term of the Agreement, You with respect to any of the Services that you elect to use, you will not assert, nor will You authorize you authorize, assist, or assist encourage any third party to assert, against NI, its affiliates us or any of their respective our customers, end users, vendors, business partnerspartners (including third party sellers on websites operated by or on behalf of us), licensors, sublicensees or licensorstransferees, any patent infringement or other intellectual property infringement claim with respect to any Services that You elect to usesuch Services.

During and after the term of the Agreement, with respect to any of the Services that You elect to use, You will not assert, nor will You authorize authorize, assist, or assist encourage any third party to assert, against NI, its affiliates DuoCircle or any of their respective its subsidiaries, customers, end users, vendors, business partners, partners (including third-party sellers on websites operated by or licensorson behalf of us) sub-licensees or transferees, any patent infringement or other intellectual property infringement claim with respect to any Services that You elect to usethe Services, the DuoCircle Properties or the DuoCircle Marks.
