Common use of Non-Collection Clause in Contracts

Non-Collection. The CONTRACTOR shall not be required to Collect any cardboard or Recyclable Materials that are not placed in a Container where such Container is placed out for Collection in the manner required herein. In the event of non-collection, the CONTRACTOR shall affix to the Container a Non- Collection Notice explaining why Collection was not made. The CONTRACTOR shall maintain a copy of such notices for a period of three (3) years.
