Non-Contingent Purchase. Buyer acknowledges and agrees that the purchase of the Property by Buyer as contemplated by this Agreement is not contingent upon the prior sale of other property owned by Buyer, and that Buyer shall be in default under the provisions of this Agreement for failure to close on or before the Close Date (as defined herein) because of Buyer’s inability to sell any such property.
