Common use of Non-Court Stand-by Clause in Contracts

Non-Court Stand-by. In order to ensure operational effectiveness, the Department may require or request its employees to be available to return to work during the off-duty hours. When this condition occurs, the employee is deemed to be on stand-by. When employees are on stand-by, they must be available by telephone or other electronic communication device and able to return to duty within one hour of receiving a request to do so. The determination for the need to place an officer on stand-by-time is at the sole discretion of the Department.
