Common use of NON-CULPABLE REASONS Clause in Contracts

NON-CULPABLE REASONS. a) the Employer assigns the employee to a site which has a vacancy or will otherwise maintain the employee’s hours through the use of floater pool, within a forty (40) kilometer radius of the site from which the employee has been DNR’ed or the employee’s home, whichever is closer, and further provided the employee has access to public transportation or has access to other suitable transportation; and, b) the assigned shift and hours of work are the same as or as close as possible to the shift and hours of work at the site the employee has been DNR’ed from; and, c) there shall be no reduction in the employee’s pay, subject to the chart above. Thereafter, the employee’s rate of pay shall be governed by the provisions of the Collective Agreement. d) in the event the employee refuses to accept any shift offered, subject to paragraph (a),
