Common use of NON-CULPABLE REASONS Clause in Contracts

NON-CULPABLE REASONS. (a) The Employer shall offer the affected employee at least three (3) sites which have a vacancy, if available, or will otherwise maintain the employee’s hours through the use of the floater pool. A copy of the sites offered will be provided to the Union. (b) The sites offered to the affected employee should be: (c) there shall be no reduction in the employee’s pay, subject to the chart above. Thereafter, the employee’s rate of pay shall be governed by the provisions of the Collective Agreement. (d) in the event the employee refuses to accept any shift offered, other than in exceptional circumstances, subject to paragraph (a), (b) and (c) above, the Employer’s obligation pursuant to these provisions shall immediately cease.
