NON-DISCLOSURE OBLIGATION OF EXECUTIVE. For purposes of this Article 3, all references to Company shall mean and include its Affiliates (as defined in Section 1.4) Executive hereby acknowledges, understands and agrees that whether developed by Executive or others employed by or in any way associated with Executive or Company, all Confidential Information, as defined in Section 3.2, is the exclusive and confidential property of Company and shall be at all times regarded, treated and protected as such in accordance with this Agreement. Executive acknowledges that all such Confidential Information is in the nature of a trade secret. Failure to mark xxx writing confidential shall not affect the confidential nature of such writing or the information contained therein.
