Common use of Non-Disturbance and Restrictions Clause in Contracts

Non-Disturbance and Restrictions. The Secured Party and each transferee of any Collateral pursuant to this Agreement shall not disturb the exercise of the rights of any third party or IXC to use fibers, appurtenances or equipment in the Available System so long as the exercise of such rights does not interfere with the exercise by PSINet of its rights to use the PSINet Fiber IRU, the IRU in the IRU Capacity or to enjoy the benefits thereof. The rights of PSINet and each such transferee hereunder are subject to the obligation to comply with Section 8, Section 15.5 and the other obligations of PSINet under the Purchase Agreement.
