Prohibitions and Restrictions. The provisions of this Agreement shall not in any way limit the right of either Contracting Party to apply prohibitions or restrictions of any kind or take any other action which is directed to the protection of its essential security interests, or to the protection of public health or the prevention of diseases and pests in animals or plants.
Prohibitions and Restrictions. Nothing in this Agreement shall be construed to prevent a Contracting Party from taking any measure necessary for the protection of its essential security interests or for reasons of public or prevention of diseases animal and plant diseases.
Prohibitions and Restrictions a. You may only use the Services for your own individual, personal and non- commercial purposes. You may not share, assign, transfer, distribute, sell, resell, give or otherwise exploit the Services for any commercial purpose in any manner whatsoever.
b. You agree not to: (i) alter any of the equipment or software that you use to access the Services; (ii) use the Services for any unlawful purpose or in any unlawful manner, or in any manner which is otherwise contrary to or violates any law, regulation or the rights of any third party; (iii) do anything to damage, disable, overburden, impair or otherwise adversely affect, as we determine in our sole discretion, the Services or any data, software, networks or equipment used to provide the Services; (iv) circumvent, disable or interfere with the security of, or otherwise abuse, the Services or any of the data, software, networks or equipment used to provide the Services, including any security features or functionality; (v) use excessive capacity, bandwidth or resources or disrupt or interfere with any other person’s use or enjoyment of the Services; (vi) use another person’s subscriber identity module (or “SIM”) card, e-mail address, password, personal identification number or other Device or information without that person’s and our prior written authorization, create or use a false identity, impersonate any person or otherwise misrepresent your identity; (vii) attempt to obtain unauthorized access to the Services or portions of the Services to which you have not subscribed or are restricted from accessing; or (viii) harass, abuse or threaten any of our employees or representatives.
c. You agree not to use the Services to send, transmit or relay: (i) anything (including without limitation viruses and trojan horses) which is intended to, is likely to or has the effect of disabling, denying access to, damaging or destroying, corrupting or affecting the normal use of the Services, or any data, software, networks or equipment used to provide the Services; (ii) any material that is or is reasonably likely to be construed as deceptive, fraudulent, libelous, defamatory, threatening, intimidating, abusive, harassing, violent, hateful, degrading, obscene, pornographic, profane, harmful or injurious to individuals, tortious or that may otherwise result in criminal, regulatory or civil liability; (iii) any material that violates any agreement, intellectual property rights, moral rights, publicity rights, privacy right...

Nothing in this Agreement precludes the host Contracting Party from taking, in accordance with its laws applied reasonably and on a non-discriminatory basis, measures necessary for the protection of its own essential security interests or for the prevention of diseases or pests.
Prohibitions and Restrictions. (1) Nothing in this Agreement shall be construed to prevent a Contracting Party from adopting, maintaining or enforcing any measure otherwise consistent with this Agreement that is considered appropriate to ensure that investment activity in its territory is undertaken in a manner sensitive to environmental concerns.
(2) Provided that such measures are not applied in an arbitrary or unjustifiable manner, or do not constitute a disguised restriction on international trade or investment, nothing in this Agreement shall be construed to prevent a Contracting Party from adopting measures or maintaining measures, including environmental measures:
(a) Necessary to ensure compliance with laws and regulations that are not inconsistent with the provisions of this Agreement;
(b) Necessary to protect human, animal or plant life or health; or
(c) Relating to the conservation of living or non-living exhaustible natural resources if such measures are made effective in conjunction with restrictions on domestic production or consumption.
(3) Nothing in this Agreement shall be construed to prevent a Contracting Party from adopting or maintaining reasonable measures for prudential reasons, such as:
(a) The protection of investors, depositors, financial market participants, policy-holders, policy-claimants, or persons to whom a fiduciary duty is owed by a financial institution;
(b) The maintenance of the safety, soundness, integrity or financial responsibility of financial institutions; and
(c) Ensuring the integrity and stability of a Contracting Party's financial system.
Prohibitions and Restrictions. The Contracting Parties may, when formulating or amending their laws and regulations, adopt measures necessary to protect the environment, provided that such measures do not impair the application of the provisions of this Agreement.
Prohibitions and Restrictions. Policy and legislation that gives rise to prohibitions or restrictions (import and export) are the jurisdiction of the relevant government departments. For ease of understanding of the obligations in terms of such requirements there is a single list of prohibition and restrictions which are managed by SARS to facilitate focussed attention on the correct prohibited and restricted goods, and that such goods must have a unique HS code allocated to them. SARS, on a frequent basis makes requests to other government agencies to notify them, in terms of their legislation, where amendments should be made to review the current prohibited and restricted goods list and to ensure that it is complete. SARS does have a published policy and Standard Operating Procedure in place which governs inter alia the amendment of the prohibition and restrictions list.

(1) The provisions of this Agreement shall not be construed as preventing a Contracting Party from taking any action necessary for the protection of its essential security interests in time of war or armed conflict, or other emergency in international relations or for the protection of public health or the prevention of diseases and pests in animals or plants.
(2) Provided that such measures are not applied in a manner that would constitute a means of arbitrary or unjustifiable discrimination by a Contracting Party, or a disguised investment restriction, nothing in this Agreement shall be construed as preventing the Contracting Parties from taking any measure necessary for the maintenance of public order.
Prohibitions and Restrictions. The Governments may not impose prohibitions or restrictions other than duties, taxes or other charges, whether made effective through quotas, import or export licences or other measures, on imports, exports or goods in transit unless they can be justified under the provisions of GATT.
