Common use of Non-Disturbance Clause in Contracts

Non-Disturbance. With respect to Security Devices entered into by Lessor after the execution of this Lease, Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "NON-DISTURBANCE AGREEMENT") from the Lender which Non-Disturbance Agreement provides that Lessee's possession of the Premises, and this Lease, including any options to extend the term hereof, will not be disturbed so long as Lessee is not in Breach hereof and attorns to the record owner of the Premises. Further, within sixty (60) days after the execution of this Lease, Lessor shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

Further, within sixty (60) 60 days after the execution of this Lease, Lessor shall shall, if requested by Lessee, use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. With respect to Security Devices now existing or hereafter entered into by Lessor after the execution of this Lease, Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "NONNon-DISTURBANCE AGREEMENTDisturbance Agreement") from the Lender which Non-Non- Disturbance Agreement provides that Lessee's possession of the Premises, and this Lease, including any options to extend the term hereof, will not be disturbed so long as Lessee is not in Breach hereof and attorns to the record owner of the Premises. With respect to Security Devices entered into by Lessor Landlord after the execution of this Lease, LesseeTenant's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "NON-DISTURBANCE AGREEMENT") from the Lender which Non-Disturbance Agreement provides that LesseeTenant's possession of the Premises, and this Lease, including any options to extend the term hereof, will not be disturbed so long as Lessee Tenant is not in Breach hereof and attorns to the record owner of the Premises. Further, within sixty (60) 60 days after the execution of this Lease, Lessor Landlord shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. In the event that Lessor Landlord is unable to provide the Non-Disturbance Agreement within said sixty (60) 60 days, then Lessee Tenant may, at LesseeTenant's option, directly contact Lessor's lender Lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

With respect to Security Devices entered into by Lessor after the execution of this Lease, Lease Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "NONNon-DISTURBANCE AGREEMENTDisturbance Agreement") from the Lender which Non-Disturbance Agreement provides that Lessee's possession of the Premises, and this Lease, including any options to extend the term hereof, will not be disturbed so long as Lessee is not in Breach hereof and attorns to the record owner of the Premises. Further, within sixty (60) days after the execution of this Lease, Lessor Lessee shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the its Premises. In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, days then Lessee may, at LesseeLessees's option, directly contact Lessor's lender Lessor leader and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

Non-Disturbance. In the event that Lessor is unable to provide the Non-Non- Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

Further, within sixty (60) days after the execution of this Lease, Lessor shall shall, if requested by Lessee, use its commercially reasonable efforts to obtain a Non-Disturbance Agreement reasonably acceptable to Lessee from the holder of any pre-existing Security Device which is secured by the Premises. In Xxxxxxxxx.xx the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) 60 days, then Lessee may, at Lessee's ’s option, directly contact Lessor's lender Lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt terminate this Lease so long as notice of such election to negotiate for terminate is given to Lessor within ten (10) days following the execution and delivery end of a Non-Disturbance Agreementsuch sixty (60) day period.

Further, within sixty (60) days after the execution of this Lease, Lessor shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

With respect to Security Devices entered into by Lessor after the execution of this Lease, Lessee's subordination of this Lease shall be subject to receiving a commercially reasonable non-disturbance agreement (a "NONNon-DISTURBANCE AGREEMENTDisturbance Agreement") from the Lender which Non-Disturbance Agreement provides that Lessee's possession of the Premises, Premises and this Lease, including any options to extend the term hereof, will not be disturbed so long as Lessee is not in Breach hereof and attorns to the record owner of the Premises. Further, within sixty (60) days after the execution of this Lease, Lessor shall use its commercially reasonable efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. In the event that Lessor is unable to provide the Non-Non- Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.

Non-Disturbance. In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessoressor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement. * See Paragraph 69.

Further, within sixty (60) days after the execution of this Lease, Lessor shall use its commercially reasonable Initial efforts to obtain a Non-Disturbance Agreement from the holder of any pre-existing Security Device which is secured by the Premises. , In the event that Lessor is unable to provide the Non-Disturbance Agreement within said sixty (60) days, then Lessee may, at Lessee's option, directly contact Lessor's lender and attempt to negotiate for the execution and delivery of a Non-Disturbance Agreement.
