Common use of Non-Diversion Clause in Contracts

Non-Diversion. During the Term, and for a period of one year after the date of termination of Employee’s employment with Employer, Employee will not divert or attempt to divert or take advantage of or attempt to take advantage of any actual or potential business or opportunities of Employer.

Business opportunities that have been considered by, and not pursued by Employer’s Board of Directors, are not covered by this provision.
