Non-Exclusive Remedy for Restrictive Covenants. Executive acknowledges that the restrictions on his activities under Sections 8, 9, 10 and 11 hereof are required for the reasonable protection of the Company. Executive further acknowledges and agrees that a breach of such obligations and agreements will result in irreparable and continuing damage to the Company and the Business for which there will be no adequate remedy at law (and will not raise such as a defense to any action brought by the Company) and agrees that in the event of any breach of said obligations and agreements, the Company and its successors and assigns, shall be entitled to temporary and permanent injunctive relief, without the necessity of showing actual monetary damages or the posting of a bond, and to such other further relief, including damages, as is proper in the circumstances. Each of the parties further acknowledges that, if the scope of any restrictions contained in Sections 8, 9 10 or 11 is too broad to permit enforcement thereof to the full extent of such restrictions, then such restrictions shall be enforced to the maximum extent permitted by law, and the parties hereby consent and agree that such scope may be judicially modified accordingly in any proceeding brought to enforce such restrictions.
