Common use of Non-Excusable Delay Clause in Contracts

Non-Excusable Delay. Delay in delivery of any Aircraft beyond the last day of the delivery month (Scheduled Delivery) established in the Purchase Agreement by any cause that is not an Excusable Delay pursuant to Article 7 of the AGTA and for which Customer is otherwise entitled to a remedy from Boeing pursuant to applicable law.

Non-Excusable Delay. Delay in delivery of any Aircraft beyond the last day of the delivery month (Scheduled DeliveryDelivery Month) established in the Purchase Agreement by any cause that is not an Excusable Delay pursuant to Article 7 of the AGTA and for which Customer is otherwise entitled to a remedy from Boeing pursuant to applicable law.

Non-Excusable Delay. Delay in delivery of any Aircraft beyond the last day of the delivery month (Scheduled DeliveryDelivery Month) established in the Purchase Agreement by any cause that is is; 1) not associated to any Aircraft delivery schedule adjustments as provided for in Reference (b), Article 1, 2) not associated to any Aircraft delivery schedule adjustments as provided for in Reference (c) and, 3) not an Excusable Delay pursuant to Article 7 of the AGTA and for which Customer is otherwise entitled to a remedy from Boeing pursuant to applicable law.

Non-Excusable Delay. Delay in delivery of any Aircraft beyond the last day of the delivery month (Scheduled DeliveryDelivery Month) established in the Purchase Agreement by any cause that is not an Excusable Delay pursuant to Article 7 of the AGTA and for which Customer is otherwise would otherwise, but for this Letter Agreement, be entitled to a remedy from Boeing pursuant to applicable law.

Non-Excusable Delay. Delay in delivery of any Aircraft beyond established in accordance with the last day Notice of the delivery month (Scheduled Delivery) established Delivery Date in Clause 5.3 hereto in the Purchase Agreement by any cause that is not an Excusable Delay pursuant to Article 7 Clause 15 of the AGTA and for which Customer is otherwise entitled to a remedy from Boeing pursuant to applicable lawPurchase Agreement.

Non-Excusable Delay. Delay in delivery of any Table 1B 737-8 or Table 1C 737-10 Aircraft beyond the last day of the delivery month (Scheduled DeliveryDelivery Month) established in the Purchase Agreement by any cause that is not an Excusable Delay pursuant to Article 7 of the AGTA and for which Customer is otherwise entitled to a remedy from Boeing pursuant to applicable law.

Non-Excusable Delay.
