Areas of the FDP Properties which constitute “wetlands” (as that term may be defined in the Corps of Engineers Wetlands Delineation Manual dated January 1987) that are not subject to jurisdiction under the Clean Water Act, shall not be developed except in conjunction with required 1:1 mitigation reasonably approved by the Town. Notwithstanding the foregoing, however, any roads, service routes and utilities crossing such non-jurisdictional wetland areas shall be permitted without mitigation, and will be located within a dedicated access and utility easement determined at the time of final subdivision platting.
