Non-performance by Customer Clause Samples
Non-performance by Customer. If Customer's non-performance of obligations in this Letter Agreement causes a delay in the Flight Crew Training, Customer will be deemed to have agreed to any such delay in Flight Crew Training. In addition, Boeing will have the right to:
(i) purchase Standby Spare Parts and invoice Customer for the price of such Parts and for any necessary adjustment and calibration of such Parts;
(ii) cancel or reschedule the Flight Crew Training.
(iii) invoice Customer for any expenses, including but not limited to ground handling expenses, maintenance costs and storage costs, that are directly attributable to the delay in the Flight Crew Training.

Non-performance by Customer. The obligations of MedEase Inc., set forth in this SLA will be excused to the extent any failures to meet such obligations result in whole or in part from Customer’s or its users failure(s) to meet the foregoing obligations. BUSINESS ASSOCIATE AND CONFIDENTIALITY AGREEMENT In the event Customer is a “Covered Entity” and MedEase Inc., is a “Business Associate” (jointly, the “Parties”), the Parties hereby enter into this Business Associate And Confidentiality Agreement (“BAA”).
Non-performance by Customer. If Customer materially breaches any of its obligations under this Agreement, including failing to pay for any Products or Services, Dell may discontinue providing service and technical support, reporting and other commitments set forth in this Agreement.
Non-performance by Customer. The obligations of Regent set forth in this Exhibit A will be excused to the extent any failures to meet such obligations result in whole or in part from Customer’s or its End Users’ failure(s) to meet the foregoing obligations.
