Common use of Non-Performance of Certain Covenants and Obligations Clause in Contracts

Non-Performance of Certain Covenants and Obligations. The Borrower shall default in the due performance or observance of any of its obligations under Section 7.1, Section 7.8 or Article VIII or any Obligor shall default in the due performance or observance of its obligations under (i) Article III or IV of the Subsidiary Guaranty, (ii) Article III or IV of a Security Agreement, or (iii) Article III or IV of a Pledge Agreement.

Non-Performance of Certain Covenants and Obligations. The Any Borrower shall default in the due performance or observance of any of its obligations under clause (d) of Section 7.17.1.1 or Section 7.1.7, Section 7.8 7.2 or Article VIII X or (b) any Obligor shall default in the due performance or observance of its material obligations under (i) Article III any Guaranty or IV of the Subsidiary Guaranty, (ii) Article III or IV of Security Agreement to which it is a Security Agreement, or (iii) Article III or IV of a Pledge Agreementparty.

Non-Performance of Certain Covenants and Obligations. The (a) Any Borrower shall default in the due performance or observance of any of its obligations under Section 7.13.4, Section 7.8 7.1.1, Section 7.1.7 or Article VIII Section 7.2 and or (b) any Obligor shall default in the due performance or observance of its obligations under (i) Article III or IV of the Subsidiary Guaranty, (ii) Article III Guaranty or IV of a the Security Agreement, or (iii) Article III or IV of a Pledge Agreement.

The Borrower shall default in the due performance or observance of any of its obligations under Section 7.17.1.1, Section 7.8 7.1.7 or Article VIII Section 7.2 or any Obligor shall default in the due performance or observance of its obligations under (i) Article III or IV 4 of the Subsidiary GuarantyGuaranty (to the extent such Article incorporates Section 7.1.1, Section 7.1.7, Section 7.2 or Section 8.1.9 of this Agreement), (ii) Article III or IV Section 4.1.5 of a Security Agreement, or (iii) Article III or IV the first sentence of Section 4.1 of a Pledge AgreementAgreement or (iv) Article I of a Mortgage.

The Borrower shall default in the due performance or observance of any of its obligations under Section SECTION 7.1, Section SECTION 7.8 or Article ARTICLE VIII or any Obligor shall default in the due performance or observance of its obligations under (i) Article Articles III or IV of the Subsidiary Guaranty, (ii) Article Articles III or IV of a Security Agreement, or (iii) Article Articles III or IV of a Pledge Agreement.

The Borrower shall default in the due performance or observance of any of its obligations under Section 7.17.1.1, Section 7.8 7.1.7 or Article VIII Section 7.2, or any Obligor shall default in the due performance or observance of its obligations under (i) Article III or IV of the Subsidiary Guaranty, (ii) Guaranty or Article III or IV of a Security Agreement, or (iii) Article III or IV of a Pledge Agreement.

The Borrower or the Parent, as applicable, shall default in the due performance or observance of any of its obligations under Section 7.17.1.1, Section 7.8 7.1.7 or Article VIII Section 7.2 or any Obligor shall default in the due performance or observance of its obligations under (i) Article III or IV of the Subsidiary Guaranty, (ii) Article III or IV of a Security Agreement, or (iii) Article III or IV of a Pledge Agreement.
