Non Potable Water. If you are a Limited Water Quality Customer we will supply Non-Potable Water to the Connection Point at your property: (a) exercising due care and skill; and (b) in a proper and workmanlike manner and to a standard expected of a member of the water and sewerage industry in Tasmania; and (c) in accordance with our statutory obligations; and (d) which is not suitable for consumption and prior to entering into this Contract you acknowledge and agree that: (i) we have specifically brought this to your attention; and (ii) you should seek and adhere to any advice issued by the Department of Health and Human Services and/or the Director of Public Health; and (iii) you accept all risks associated with any use of the Non-Potable Water.

Non Potable Water. After the Closing Date, notwithstanding any purification and filtration improvements made by Purchaser to the water distribution aspects of the Business, Purchaser shall continue to provide non-potable water to the Water Companiesexisting customers for such non-potable water pursuant to the terms and for the duration of the Contracts listed on Schedule 3.3(c).
Non Potable Water. The parties acknowledge that off-site water irrigation lines for use of untreated surface water or sanitary sewer effluent may be installed by Seller, when necessary to supply non-potable water (although neither Seller nor TRIGID are under any obligation to Buyer to construct off-site water lines for non-potable water). Buyer, at the Buyer’s sole expense, shall be required to construct a separately metered water irrigation system for landscaping, cooling or industrial applications (and any other use for which non-potable water can be used) which will allow the delivery and use of non-potable water, if available from the TRIGID. The parties intend that, if made available, non-potable water shall be used for all irrigation purposes (and other non-potable water uses such as cooling, industrial or manufacturing uses) possible on the Real Property. TRIGID shall have the sole discretion to decide when there is a sufficient quantity of non-potable water in order to deliver non-potable water to any portion of the Real Property for irrigation, cooling, manufacturing, industrial or other uses. Notwithstanding the forgoing, Buyer may reject non-potable water for its process uses if such water does not meet Buyers water quality specifications, in Buyer’s sole discretion. Non Potable Water. The portions of paragraph 2.1 (“Water Utilities”) of the Original SG DA relating to non-potable water service are hereby deleted. Any rights or obligations of the De- veloper regarding the provision of non-potable water service at the Subject Property shall con- form to the requirements, if any, of CMID.

Non Potable Water. Operator shall be responsible for providing a non-potable water supply as required for its operations at the ORDOT FACILITY. All costs pertaining to any water line extension or relocation thereof, shall be the sole responsibility of Operator, including the charges imposed by any utility company. No water leakage shall be allowed. Any repairs on these water delivery facilities shall be the responsibility of Operator.
Non Potable Water. Provider and District agree that the District’s Customers would be best served, where feasible and if economically viable in the opinion of each of Provider and District, to: (i) develop the District Water System to include a “dual pipe distribution system”; and (ii) use non-potable water for non-residential irrigation purposes including, but not limited to, common areas, parks, community spaces, schools, and other open spaces.
