Non-Reliance on the Agents and Other Secured Creditors. Each Secured Creditor expressly acknowledges that neither the Security Trustee nor any of its respective officers, directors, employees, agents, advisors, attorneys-in-fact or affiliates have made any representations or warranties to it and that no act by the Security Trustee hereafter taken, including any review of the affairs of Concessionaire, shall be deemed to constitute any representation or warranty by the Security Trustee to any Secured Creditor. Each Secured Creditor represents to the Security Trustee that it has, independently and without reliance upon any other Secured Creditor, and based on such documents and information as it has deemed appropriate, made its own appraisal of and investigation into the business, operations, property, financial and other condition and creditworthiness of Concessionaire and its Affiliates and made its own decision to make the Loans or purchase the Senior Bonds and enter into this Agreement and the other Funding Documents to which it is a party. Each Secured Creditor also represents that it will, independently and without reliance upon the Security Trustee or any other Secured Creditor, and based on such documents and information as it shall deem appropriate at the time, continue to make its own credit analysis, appraisals and decisions in taking or not taking action under this Agreement, the other Funding Documents and the Intercreditor Agreements, and to make such investigation as it deems necessary to inform itself as to the business, operations, property, financial and other condition and creditworthiness of Concessionaire and its Affiliates. Except for notices, reports and other documents expressly required to be furnished to the Secured Creditors by the Security Trustee under the Funding Documents or the Intercreditor Agreements, the Security Trustee shall not have any duty or responsibility to provide any Secured Creditor with any credit or other information concerning the business, operations, property, condition (financial or otherwise), prospects or creditworthiness of Concessionaire that may come into the possession of the Security Trustee or any of its officers, directors, employees, agents, advisors, attorneys-in-fact or affiliates.
