Common use of Non-standard System Impact Clause in Contracts

Non-standard System Impact. If Seller incurs non-standard costs to maintain or repair the System due to conditions at the Facility known to Customer and not disclosed by Customer to Seller, or not reasonably apparent to Seller upon the inspection referred to in Section 12(a)(i), or due to the inaccuracy of any information provided by Customer and relied upon by Seller, the pricing, schedule, and other terms of this Agreement may be equitably adjusted to compensate for any work in excess of normally expected work required to be performed by Seller. In such event, the Parties will negotiate such equitable adjustment in good faith.
