Common use of Noncomplying Product Clause in Contracts

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year one‐year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, but not more than 30 days (unless as mutually agreed) Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys unused, pre-paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten thirty (1030) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

In the event DOD determines demonstrates that the Product is a Noncomplying Product, during the one-year period specified aboveWarranty Period, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher Licensor agrees that DOD DoD may return the Product and Publisher Licensor shall promptly refund any moneys paid for such Noncomplying Product.

In the event DOD determines that the Product is a Noncomplying Product, during the one-year warranty period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the oneninety-year day period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid prepaid for such Noncomplying ProductProduct for the unused period of the applicable subscription term.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund of any moneys paid for such Noncomplying ProductProduct from the time of Noncompliance.

Noncomplying Product. In the event DOD determines that the Product is a Noncomplying Product, during the one-year warranty period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable timetime (but in any event not less than ten (10) business days), Publisher agrees that DOD may return terminate its license to the Product Software and Publisher shall promptly refund any moneys paid prepaid for such Noncomplying ProductSoftware on a pro rata basis for the remainder of the then- current subscription term.

In the event DOD determines that the Product is a Noncomplying Product, during the one-year period specified above, DOD will notify Licensor and Licensor will have ten (10) business days thereafter to begin remedying the nonconformance. If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.Product.‌

If Licensor is unable to remedy such nonconformance within a reasonable time, Publisher agrees that DOD may return the Product and Publisher shall promptly refund any moneys paid for such Noncomplying Product.
