A Nondiscrimination clause prohibits parties from engaging in discriminatory practices based on protected characteristics such as race, gender, religion, age, or disability. NONDESCRIMINATION. No person shall, on the grounds of race, creed, color, national origin, gender, marital status or the presence of any sensory, mental or physical handicaps, be excluded from participation in or be denied the benefit of, or otherwise be subjected to discrimination with regard to any activity pursuant to this Agreement.
NONDESCRIMINATION. Carrier certifies that Carrier has a written policy and practice that meets the requirements, described in ORS 279A.112, of preventing sexual harassment, sexual assault, and discrimination against employees who are members of a protected class. Carrier agrees, as a material term of the Contract, to maintain the policy and practice in force during the entire Contract term.

The District and Association shall not discriminate against any bargaining unit member in matters of salaries, fringe benefits, similar terms and conditions of employment, or any other conditions of this Agreement on the basis of race, ethnicity, sex, gender, gender identity, gender expression, sexual orientation, color, religion, age, physical handicap, disability, marital status, change in marital status, political affiliation, veteran status, or national origin, or union membership status or activism. Further, all personally identifiable and/or medical information as relating to any of the above shall be considered confidential information and will not be released except as required by local, state, or federal law. The Board shall respect and uphold each employee’s right to privacy and constitutional rights as citizens.
