Common use of Notice and Cause Clause in Contracts

Notice and Cause. An adjunct who has obtained the service level in Paragraph 1 and who has commenced performing a teaching assignment may be suspended without pay or removed from that teaching assignment only for cause. The adjunct must be given notice in writing, except as otherwise specifically provided herein, of the conduct for which the suspension or removal action is being taken. An adjunct receiving a notice of proposed suspension or removal for disciplinary reasons will be afforded an opportunity to meet with the president of the college in which the conduct occurred or his/her designee to respond to the proposed action prior to the effective date of the action. The adjunct may be accompanied by a union representative.
